General Terms and Conditions of the company Street-Files Ltd. (hereafter called “we”), apply to the Internet shop www.street-files.com
 

 

1. VALIDATY OF THE TERMS AND CONDTIONS

All deliveries and services are based to the following terms and conditions. The contract of sale is subject to the Schweizeriches Obligtionenrecht (OR) as well as Swiss law.
 

2. SUPPLY AND CONCLUSION OF CONTRACT

Our prices are effectively without obligation. Any offer can be withdrawn, as long as there is no other written agreement. The contract is accepted once the customer receives its goods. The amount and fulfilment of the delivery is defined in the electronic confirmation of purchase. There is no right of rescisson.
 

3. DELIVERY CONDITIONS AND DELAYS

Street-Files Ltd. only accepts orders carried out over the web site www.street-files.com. The items will be delivered at the indicated shipping fee. All orders are sent by Swiss Post and are insured. Shipments to customers living outside of Switzerland may be subject to import duties and taxes, which are to pay by the recipient. Delivery dates are depending to the postal services in the land where the order was made; therefore we are unable to guarantee delivery times. If the buyer refuse to accept his order, we will not reimburse any postal or delivery costs.

Customer, who order per Cost On Delivery and do not accept the delivery, will be charged with a CHF 50 fee.
 

4. PRICES AND PAYMENT CONDITIONS

All prices are indicated in Swiss Francs and Euros including 8.0% VAT. A delivery will only occur due to payment by credit card (VISA, EURO-MASTERCARD, SWISS POSTCARD), Billpay and Paypal. If the delivery address is outside of Switzerland, the customer agrees to take on all import duties and taxes. For Swiss Customers we also offer a cash on delivery service.
 

5. RETURNS

All articles will be controlled by Street-Files Ltd. Returns of purchased items should be sent back, including all packaging and without any traces of use. The customer has to pay all shipping cost for returns and exchanges.

The return of goods will be rejected, if
> there are traces of use
> the product is returned without the original packaging and manuals.
> the goods are damaged due to transportation

If the item gets lost during the return shipping, Street-Files Ltd. will not refund the amount. We recommend sending the goods using a track & trace shipping service. If the product is accepted from Street-Files to take back, we will send our customers the value as a online voucher.
 

6. LIABILITY

Our liability for lost, stolen or damaged goods is in accordance with Swiss law. In the event of an exceptional case, we are only liable for the maximum worth of the transaction. Should the customer choose to resell the goods, he/she is responsible for following all export regulations. If the customer alters the reselling item, he/she is responsible for any resulting damage, to the end customer and/or third parties.
 

7. DATA SECURITY

All data is protected by the tried and tested SSL-Technology. Each transaction will be authorised and checked by the appropriate credit card company. Blocked or false credit cards cannot be used. We obligate ourselves not to pass on or resell our customers information.
 

8. PROTECTION OF INTELLECTUAL PROPERTY

Street-Files Ltd. is the sole owner of the design. The content of the website is protected by copyright law. Modifications, Reproductions and copies of any sort are expressly forbidden.
 

9. FINAL PROVISION

Jurisdiction lies within the courts of Zurich. However we may appeal to the courts in the customer country of residence. Swiss law is applied exclusively, also when orders are placed from and goods are delivered abroad. The parties will endeavour to settle any arguments that may arise from the realization of the sales contract in an amicable way. With the placing of an order the customer accepts these general terms and conditions. Street-Files Ltd. reserves the right to alter the terms and conditions at any time.
